Success in a Marital and Family Law Firm

The Divorce Litigation Process

The challenges that face a family during the divorce litigation process create elevated levels of emotional stress and anxiety both for the parties and for the people that come into contact with them. In dealing with the highs and lows of a client’s perception, it is imperative to have a great team of support at the office behind the scenes.

In our marital and family law firm that focuses on complex, often high conflict divorce cases, there is no room for error. Every time there is a hearing in which testimony is provided, argument made, or evidence presented, our attorneys must perform at or above 100%. How do we achieve this benchmark at all stages of the litigation? This level of professionalism requires all cylinders of the machine to operate in sync.

Prior Preparation Prevents Poor Performance

The 5 “P’s” must be applied to every issue, including the hiring and retaining of staff as well as every case the firm faces: Prior Preparation Prevents Poor Performance. Paraphrased from an old British military slogan, this has been applied to countless situations over the years. The simplicity of the statement speaks volumes of wisdom. Every matter, hearing, deposition, mediation, discovery review and request, client conference, witness testimony, and trial requires thoughtful preparation.

If you are completely prepared at each step of the process with all of the facts, both relevant facts and those that may tend to be or lead to a relevant fact, and if you are prepared with the most current statutory law, legislative history, and case law on the issues presented, there will be minimal anxiety, stress greatly mitigated, and expectation of successful resolution many times increased. With this preparation, our attorneys are able to present themselves at each scheduled event with the optimum level of confidence regardless of the opposing attorney, parties, Judge, or complexity of issues on the case.

Although the idea of preparation is something most of us take as a canon of divorce and custody litigation, due to time constraints, conflicting schedules, delays in discovery, personal life issues, and other unexpected events, preparation often cannot logistically be appropriately detailed and completed by one person. Thorough preparation requires team work and pays off when confronting the unexpected.

Preparation of trial notebooks, organization of discovery, letters to clients regarding specific matters, first drafts of documents, dictation, and scheduling, from your first client conference, are functions that are delegated to a person in the firm that has reached a certain level of experience and a certain level of confidence in themselves, their attorney and in our client.

The success of our marital and family law attorneys greatly depends upon the firm’s ability as a cohesive unit both in talent and in personality to fully and adequately prepare the attorney and the client for what lies ahead.
